Terms and Conditions, Effective
You agree that event attendance by yourself and your guests is subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not register for events. Basic definitions in this document: (1) “HO'S INC” or "SOUTH SHORE" means DBA SOUTH SHORE, LLC, an entity incorporated in the State of Montana; (2) “Site” means..... (3) “Our(s),” “We,” and “Us” means SOUTH SHORE LLC, the Site, and extends to the business together with all owners, partners, and employees; (4) “You(‘re),” “Your,” or “Customer” mean a website visitor/user, account holder, event purchaser, event participant or any other user of our Services; (5) “Service(s)” means use of and anything provided on our Site, excluding third party links, and attendance, participation, product(s), and any instruction offered and/or provided by/at SOUTH SHORE LLC. “Service(s)” also includes any other product or service that we offer or provide to you that references this Terms and Conditions Agreement (“Terms”).
Privacy Policy
SOUTH SHORE LLC may use your email address for marketing purpose. HOWEVER, SOUTH SHORE does not sell your information to OUTSIDE organizations; nor do we share your email address or any other private information about you with others, except as required by law. By attending a class or event, you are granting SOUTH SHORE permission to use photographic and/or video images of you for the purpose of marketing, publicizing, and promoting SOUTH SHORE . Attending events waives any right to be compensated for the use of my image and releases SOUTH SHORE from liability for any claims, where such claims arise out of or relate to SOUTH SHORE 'S use of your image.
Limitation of Liability
You agree to the fullest extent allowed by law, to release any and all claims you may have against us, our owners, managers, members, employees and other representatives (hereinafter, “Agreement Beneficiary”) relating to or arising out of any property damage, personal injury or illness you may incur while attending or participating in an event. You also agree to pay any costs, including reasonable attorney’s fees incurred by any Agreement Beneficiary to enforce these Terms. You consent that these Terms are deemed to have been made in the State of Montana and Montana law will apply to interpretation and enforcement.
I hereby release and agree to hold SOUTH SHORE harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of SOUTH SHORE , or that may otherwise arise in any way in connection with any services received from SOUTH SHORE . I understand that this release discharges SOUTH SHORE from any liability or claim that I, my heirs, or any personal representatives may have against SOUTH SHORE with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from SOUTH SHORE. This liability waiver and release extends to the business together with all owners, partners, and employees.
Cancellation Policy
As it pertains to public events at SOUTH SHORE , a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled event and receive a full credit less processing fee. Credit is issued in lieu of cash refund. Credit can be applied toward the purchase of a future product or service of SOUTH SHORE. Credit does not expire and is fully transferable to another individual. SOUTH SHORE does not issue credits within 24 hours of any event or for absent guests.
As it pertains to public group events in which Customers pay separately, a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled event and receive a full cash refund less processing fee. Refunds will be issued only insofar as the predetermined group minimum is maintained. In the event cancellations are requested in violation of the group minimum, SOUTH SHORE is entitled to retain the cash value of the predetermined group minimum, and Customer(s) is (are) entitled to reschedule the event and apply existing cash value of the predetermined minimum (and any amount exceeding such) to the rescheduled event. SOUTH SHORE does not issue refunds within 24 hours of any events or for absent guests.
As it pertains to private group events in which Customers pay as a whole and by means of a deposit and reconciliation, a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled events and forfeit their deposit. In such case, SOUTH SHORE is not entitled to collect the balance or reconciliation of the purchase. Should the Customer choose to reschedule the event, SOUTH SHORE may or may not, at its sole discretion, apply the deposit to the rescheduled event. SOUTH SHORE is entitled to collect the balance, and retain the deposit, of any cancellation requested within 24 hours of any event or for absent guests.
SOUTH SHORE reserves the right to cancel any event due to inclement weather at its sole discretion upon four hours’ documented notice to Customer, in which case customer is entitled to either a full credit or full refund at their sole discretion.
As it pertains to any and all cases not defined herein, SOUTH SHORE is obligated to resolve the case with fair and reasonable effort.
